I'm pretty sure that is in reference to evidence pertaining to their crimes. Surveillance is like CCTV. It often doesn't make sense until after an event has occurred. Then you look back and realize what a piece of intel means.
Lastly, Q/White Hats/POTUS has to let some acts happen for multiple reasons. One of which being not divulging methods and sources.
Mass killing innocent people is a crime. They haven't done so with immunity for years. Even if they can only make sense of it after the fact, why hasnt anything been done in that time? Theres a disconnect from what we are being told and telling ourselves, and the reality of what's happening.
All due respect, I think you are oversimplifying things. The big plots are getting disrupted - WMD in particular. The big threats. There aren't enough resources (special operations) to run down every potential threat. And then that brings us back to sources and methods. Don't give up your intel feeds which can save thousands, in order to save a few. I'm not saying that's what's going on, but that's how intel collection/action works.
